By accessing or using getaxcp.com (the "Website") and any services, software, or documentation provided by TradePhantom LLC ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Website or our services.

These Terms constitute a legally binding agreement between you and TradePhantom LLC regarding your use of the AXCP Protocol and related services.

2. AXCP Protocol License

The AXCP (Adaptive eXchange Context Protocol) is available under different licensing tiers:

Full license texts are available in our GitHub repository. The Apache 2.0 license for AXCP Core grants you the freedom to use, modify, and distribute the software, subject to the terms of that license.

3. Use of Website

You agree to use this Website only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Website in any way that violates any applicable federal, state, local, or international law or regulation
• Attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Website
• Attempt to gain unauthorized access to any portion of the Website, other accounts, computer systems, or networks connected to the Website

• AXCP Trademark: "AXCP" and "Adaptive eXchange Context Protocol" are trademarks of TradePhantom LLC. You may not use these marks without prior written permission.
• Documentation: All documentation is licensed under Creative Commons Attribution 4.0 International (CC-BY-4.0).
• SDK Code: The Core SDK source code is licensed under the Apache 2.0 license, allowing modification and redistribution with attribution.
• Website Content: All other content on this Website, including text, graphics, logos, and images, is the property of TradePhantom LLC and protected by copyright laws.

5. Disclaimer of Warranties

THE WEBSITE AND ALL INFORMATION, CONTENT, MATERIALS, AND SERVICES PROVIDED THROUGH THE WEBSITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

• Your use of the Website or the AXCP Protocol

• Any claim that your use of the AXCP Protocol caused damage to a third party

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States of America, without regard to its conflict of law provisions.

You agree that any legal action or proceeding between you and TradePhantom LLC shall be brought exclusively in the federal or state courts located in New Mexico, and you consent to the personal jurisdiction of such courts.

9. Dispute Resolution

Before filing a claim against TradePhantom LLC, you agree to try to resolve the dispute informally by contacting us at enterprise@getaxcp.com. We will attempt to resolve the dispute informally through good faith negotiations for at least 30 days before either party initiates arbitration or litigation.

If a dispute cannot be resolved through informal negotiations, you and TradePhantom LLC agree to resolve any claims relating to these Terms through final and binding arbitration, except as set forth below.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting the updated Terms on this page and updating the "Last Updated" date.

Your continued use of the Website after the effective date of the revised Terms constitutes your acceptance of the terms.

11. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
